Modernization of Cosmetics Regulation Act of 2022 (MoCRA), voted on by the US Congress on December 29, 2022, has profoundly changed the cosmetics regulatory framework in United States as of the end of 2023. According to the MoCRA law, the “Responsible Person” who must fulfill all obligations of the products is the natural or legal person mentioned on the label of the cosmetic product. This person can be anyone from the manufacturer, packer, importer and distributor, provided that it meets the requirements to fulfill all responsibilities during the placing of cosmetic products on the market. The MoCRA law also requires facilities to be recognized by the FDA.
Brand owners (Responsible Person) and facilities located outside the United States must have an U.S. Agent located in the United States.
As your U.S. Agent, we represent your products and you before the FDA in the best possible way, in line with all legal requirements, by creating a bridge between you, the responsible person and facility owners, and the FDA.
